Terms of Service

Last updated October 3, 2026

1. Agreement to these Terms

These Terms of Service ("Terms") govern your access to and use of TabbyCat, the website at tabbycat.app (and any related web addresses we use), and the TabbyCat application and related services (together, the "Service"). The Service is operated by Media Plaid LLC d/b/a “DEVSIO”, a limited liability company organized under the laws of the Commonwealth of Virginia ("DEVSIO," "we," "us," or "our").

By creating an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility and Accounts

You must be at least 18 years old to create an account. If you are 13 or older but under 18, you may use the Service only with the involvement and consent of a parent or legal guardian, who agrees to these Terms on your behalf.

You are responsible for maintaining the confidentiality of your sign-in credentials and for all activity that occurs under your account. You must notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

You agree to provide accurate account information, including your email address and, where requested, your name and mobile number, and to keep it current.

3. Entertainment and Personal Use Only

The Service is provided for personal, non-commercial, and entertainment purposes only. TabbyCat is a casual tool for splitting shared expenses with friends and groups.

  • The Service is not a financial, accounting, banking, invoicing, tax, or legal service, and nothing in it constitutes financial, accounting, tax, or legal advice.
  • The Service does not hold, transfer, process, or settle real money or payments. Any settlement between group members happens entirely outside the Service (for example, a cash payment or a peer-to-peer payment app you choose to use). We are not a party to, and are not responsible for, any payment or settlement between you and the people in your groups.
  • You may not use the Service for commercial purposes, to operate a business, or to provide bookkeeping or accounting services to third parties, without our prior written consent.

4. No Guarantee of Accuracy

Portions of the Service rely on automated processing, including artificial-intelligence-based reading of receipt images, and on information entered by you and the other people in your groups.

  • We do not warrant or guarantee that any information presented in the Service — including amounts, line items, merchant names, dates, tips, taxes, totals, balances, and splits — is accurate, complete, or up to date.
  • Automated receipt reading may misread or omit details. Information entered by other users may be wrong. Always review results before relying on them.
  • To the fullest extent permitted by law, DEVSIO shall not be held liable or accountable for any information that is not presented accurately, or for any loss, cost, expense, dispute, or damages arising from your reliance on information presented in the Service. You are solely responsible for verifying any figures before acting on them.

5. Your Content; Storage and Retention

"Your Content" means the information, photos, and other materials you and the people in your groups submit to the Service, including trip and tab details, expense amounts and notes, receipt images, names, and payment handles.

  • You retain ownership of Your Content. You grant us a limited, worldwide, non-exclusive license to store, process, reproduce, and display Your Content solely as needed to operate and provide the Service (for example, showing a receipt to your group, or reading it with AI).
  • We are not responsible for holding, maintaining, or storing any information for any period of time, and we do not promise to keep it available to anyone who uses the Service indefinitely. Data may be lost, corrupted, or become unavailable due to system failures, maintenance, upgrades, or for other reasons. You should keep your own records of anything important to you.
  • You can delete content, trips, tabs, and your account from within the Service. When you do, the information is removed in accordance with our Privacy Policy. We may also delete or archive content that is inactive, that violates these Terms, or where required by law.
  • You are responsible for obtaining any consents required from other people before submitting their personal information (such as names or mobile numbers) to the Service.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation;
  • Harass, threaten, defraud, or harm other users;
  • Upload content you do not have the right to upload, including content that infringes any copyright, trademark, privacy, or other right;
  • Scrape, crawl, harvest, or systematically extract data from the Service;
  • Reverse engineer, decompile, or attempt to derive the source code, algorithms, or models underlying the Service, except as permitted by applicable law;
  • Interfere with or disrupt the Service, including through automated traffic, denial-of-service activity, or attempts to gain unauthorized access;
  • Circumvent or attempt to circumvent access controls, including trip codes, tab links, code words, or other security features;
  • Misrepresent your identity or affiliation, or use the Service to impersonate others;
  • Use the Service to facilitate gambling, money transmission, or the sale of regulated goods or services.

7. Our Brand and Intellectual Property

  • Ownership. The Service, including the TabbyCat name, logo, "Split tabs with friends" tagline, design, text, graphics, software, and all related intellectual property rights, is and remains the exclusive property of DEVSIO and its licensors. Nothing in these Terms transfers any ownership rights to you.
  • Limited license. We grant you a personal, revocable, non-exclusive, non-transferable license to access and use the Service for its intended, personal purposes, subject to these Terms.
  • Brand protection. You may not use the TabbyCat name, logo, or any of our trademarks, trade names, service marks, or trade dress — including any confusingly similar variation — in any way without our prior written permission. This includes using them in domain names, app names, social handles, advertising, marketing, metatags, or keywords, or in a manner that implies endorsement, sponsorship, or affiliation with us.
  • No derivative works. You may not copy, modify, create derivative works of, publicly display, or distribute any part of the Service except as expressly permitted by these Terms.
  • Feedback. If you send us feedback, ideas, or suggestions, you grant us a perpetual, irrevocable, royalty-free right to use them without restriction or compensation.
  • Remedies. Unauthorized use of our brand or intellectual property may cause irreparable harm for which monetary damages are inadequate, and we may seek injunctive relief in addition to all other remedies available at law or in equity.

8. Third-Party Services

The Service relies on third-party providers (for example, cloud hosting, AI-based receipt reading, and email delivery) and may contain links to third-party websites or services. We do not control and are not responsible for third-party services. Your dealings with any third party, including payments made through peer-to-peer payment apps, are solely between you and that third party.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED.

Some jurisdictions do not allow certain warranty disclaimers, so some of the above may not apply to you.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

  • NEITHER MEDIA PLAID LLC NOR ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, OR SUPPLIERS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE.
  • OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (US $100) OR (B) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE.
  • WE ARE NOT RESPONSIBLE FOR DISPUTES, LOSSES, OR DAMAGES ARISING BETWEEN YOU AND THE OTHER MEMBERS OF YOUR GROUPS, INCLUDING UNPAID BALANCES OR SETTLEMENTS.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless DEVSIO and its owners, officers, employees, contractors, and suppliers from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) Your Content; (c) your violation of these Terms; (d) your violation of any law or the rights of any third party; or (e) any dispute between you and other members of your groups.

12. Termination

  • By you. You may stop using the Service and delete your account at any time.
  • By us. We may suspend or terminate your access to the Service, with or without notice, if you violate these Terms, if we discontinue the Service, or for any other reason. Upon termination, your right to use the Service ends immediately, and sections that by their nature should survive (including Sections 4, 5, 7, 9, 10, 11, and 15–18) will survive.

13. Changes to the Service and these Terms

We may modify or discontinue the Service, or any part of it, at any time with or without notice. We may also update these Terms from time to time. If we make material changes, we will update the date at the top of these Terms and may provide additional notice (for example, by email or in the Service). Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law and Venue

These Terms are governed by the laws of the Commonwealth of Virginia, USA, without regard to its conflict-of-laws principles. You and DEVSIO agree that the state and federal courts located in the Commonwealth of Virginia will have exclusive jurisdiction over any dispute arising out of or relating to the Service or these Terms, and you consent to the personal jurisdiction and venue of those courts.

15. Severability

If any provision of these Terms is found unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and DEVSIO regarding the Service and supersede any prior agreements or understandings.

17. Assignment

You may not assign or transfer these Terms or any rights under them. We may assign these Terms, in whole or in part, at any time, including in connection with a merger, acquisition, or sale of assets.
